An agreed let that waits a week for signatures is a week of void rent and a week for the applicant to find somewhere else. This guide is the same-day workflow a landlord or letting agent in England can run from an accepted offer at nine in the morning to a signed tenancy, a protected deposit and a complete file by five, with the law behind each step and the evidence each step leaves. Notes on Wales, Scotland and Northern Ireland are at the end.
The day at a glance
| When | What happens | What it proves |
|---|---|---|
| Before the day | Template built: agreement with the written statement, deposit information, safety documents, roles for tenants and landlord. | Every tenancy uses the same approved wording. |
| 09:00 | Offer agreed, referencing passed. Create the pack from the template, fill names, rent, deposit and start date, send with SMS codes for tenants you have not met. | The written statement was given before the tenancy was entered into. |
| 09:05 to 14:00 | Each tenant opens the link on their phone, reads, ticks the acknowledgements, signs. Reminders chase anyone who stalls. | Who signed, when, from which address and device, after seeing exactly which file. |
| 14:30 | You countersign. The pack is sealed; everyone receives the file and certificate. | The moment the tenancy was concluded. |
| 15:00 | Deposit protected, dates recorded from the certificate, inventory scheduled for move-in. | The 30-day deposit clock and the file for any later dispute. |
Before the day: the template
The speed comes from the preparation. Build one template for your standard tenancy pack and keep it current:
- The agreement itself, for a tenancy in England granted on or after 1 May 2026 a periodic assured tenancy under the Renters' Rights Act 2025, with the written statement of terms built into it (see below). Fields: full names, signatures and dates for each tenant and for you; the rent, deposit and start date as pre-fillable read-only fields so the tenant sees the figures but cannot change them.
- The deposit prescribed information, with your scheme's details, as a read-and-acknowledge document the tenant ticks.
- The gas safety record, EPC and electrical report, also as acknowledgements, so service is evidenced in the same certificate.
- Roles, not names: "Tenant 1", "Tenant 2", "Landlord". Give tenants the same order number so they sign in parallel, and yourself the next number so you sign last.
- Defaults: a subject and message, a reminder after one day repeating daily, and an expiry of three to five days so an offer does not hang around.
Anchor the fields to text in the agreement ("Signed by the Tenant", "Rent:") so that when your solicitor revises the wording you upload the new file and the fields re-place themselves. How templates work.
Morning: offer agreed, pack sent
Referencing is back and the offer is agreed. Open the template, type each tenant's name and email address (their own, not a shared one), fill the rent, deposit and start date, and choose how each tenant proves it is them. For tenants you have met in person, the email link and the audit trail are what most agents rely on. For tenants you have only spoken to online, add an SMS one-time code; the phone number then appears on the certificate. Send.
Why this order works legally: an ordinary residential tenancy of three years or less does not have to be a deed (Law of Property Act 1925, s 54(2)), so no witness is needed, and the Electronic Communications Act 2000, the retained eIDAS Regulation and the Law Commission's 2019 report together mean an electronic signature on it is as effective as ink. The legal-validity page has the detail; the tenancy law guide covers the exceptions.
The written statement of terms
The Renters' Rights Act 2025 received Royal Assent on 27 October 2025 and its first phase took effect on 1 May 2026. From that date a landlord granting a new private tenancy in England must give the tenant written information about the key terms of the periodic assured tenancy before the tenancy is entered into. The draft regulations list the categories: the parties and the property, rent and how it is paid, notice requirements, the deposit, the landlord's repairing and safety obligations, fitness for habitation, and certain tenant rights such as the right to request consent to keep a pet. The statement can be a separate document or be included in the tenancy agreement itself.
For a same-day signing the second route is the practical one: the written statement sits inside the agreement, the tenant reads and signs it, and the certificate's "viewed" event timestamps the moment the statement was available to them, which is before the moment they (and later you) signed. Keep the exact wording current with GOV.UK guidance, because the information sheet and statement requirements were still being finalised in early 2026; tenancies that began before 1 May 2026 needed a standard information sheet by 31 May 2026 rather than a full statement.
Afternoon: tenants sign
Each tenant opens their own link, sees the whole pack, ticks the acknowledgement for each document you must serve, fills any fields you left for them (a forwarding address, an emergency contact), and signs by drawing or typing. If something is unclear they can leave a comment, which reaches you by email, rather than going quiet. If they are the wrong person (a parent who passed the email on, say) and you allowed delegation, they can hand the contract to the right tenant with a reason recorded.
Two tenants signing from one phone is the mistake to avoid. Each signature must be attributable to its person: own email, own device where possible, own SMS code. The audit trail records the email address, IP address, browser and time zone for each event, so two signatures from one device at the same minute would be visible later, and not helpful.
You countersign and the deposit clock starts
When the last tenant finishes you are invited to sign. Read the certificate preview first: it shows each tenant's events and identity method. Sign. The pack is sealed: the fields are fixed into the file, the certificate is appended, the file carries a tamper-evident digital seal and its SHA-256 fingerprint is recorded. Everyone receives the final file by email, and the tenancy is concluded at the time shown as "Completed".
Now the statutory clocks matter. The deposit must be protected in an authorised scheme and the prescribed information given within 30 days of receipt (Housing Act 2004, s 213). Record the completion date from the certificate in your register alongside the deposit receipt date, protect the deposit the same afternoon, and keep the scheme certificate with the pack. Audit trails explained walks through what each line of the certificate proves if a deposit or possession dispute arises later.
What else must be served, and how to prove it
| Document | Requirement | In the pack |
|---|---|---|
| Written statement of terms | Before the tenancy is entered into (Renters' Rights Act regime) | Inside the agreement; "viewed" and "signed" events timestamp it. |
| Deposit prescribed information | Within 30 days of receiving the deposit (Housing Act 2004, s 213) | Read-and-acknowledge document; acknowledgement on the certificate. |
| Gas safety record | Before the tenant moves in; annually thereafter | Read-and-acknowledge document. |
| EPC and electrical safety report | EPC before letting; electrical report before occupation or within 28 days of inspection | Read-and-acknowledge documents. |
| Inventory and check-in | Good practice, essential for deposit disputes | A separate contract on move-in day, with an attachment field for the tenant's photos. |
| Right to rent | Immigration check before the tenancy starts (England) | Not a signing matter; keep check records separately. |
For a portfolio, the same acknowledgement documents can go to every existing tenant at once with bulk send, each tenant receiving their own copy and certificate.
If there is a guarantor
A guarantee must be in writing and signed by the guarantor (Statute of Frauds 1677, s 4). Many guarantor agreements are drafted as deeds; if yours says "executed as a deed" or has a witness block, it needs a witness physically present under the Law of Property (Miscellaneous Provisions) Act 1989 and the Law Commission's view that remote witnessing does not satisfy the requirement, and it should be signed on paper or through a conveyancer's process. If it is drafted as a simple contract supported by consideration, send it as its own contract to the guarantor's own email with an SMS or access code, since guarantors are the party most likely to say later that they never signed. Do not add the guarantor to the tenants' pack: their signing should stand on its own evidence.
What goes wrong, and the fix
- A typo in the rent after sending. Before anyone has signed, use "correct": the pack is voided and reissued under the same ID with a "corrected" event. After a signature, void and resend; the trail shows both.
- A tenant's email bounces. Change the recipient's address from the contract page; the new invitation and the change are recorded.
- A tenant stalls. The reminder schedule nudges them; the "viewed" event tells you whether they have even opened it. A phone call at 14:00 fixes most stalls.
- You forgot a document. Send it as a separate acknowledgement the same day. Its certificate carries its own timestamp; service is still evidenced, just across two files.
- The agreement is for more than three years, or a deed. Stop. It needs a deed with a witness present, and leases over seven years need registration under HM Land Registry's rules. Use paper or a conveyancer.
Wales, Scotland and Northern Ireland
Wales uses occupation contracts under the Renting Homes (Wales) Act 2016, with a written statement of the contract required within 14 days of occupation; the law of electronic signatures is the same as England's, so the same-day pack works with the Welsh documents substituted. Scotland uses the private residential tenancy under the Private Housing (Tenancies) (Scotland) Act 2016 with a model agreement and statutory notes; electronic documents and signatures are governed by the Requirements of Writing (Scotland) Act 1995, which recognises them, and an ordinary PRT can be signed electronically. Northern Ireland requires a tenancy information notice under its private tenancies legislation and follows a law of deeds and signatures similar to England's. In every case the principle holds: ordinary residential tenancies are not deeds and can be signed on the day; deeds need a witness in the room.
Frequently asked questions
Is a same-day tenancy signing legally sound?
Yes, provided the agreement is one that can be signed electronically (an ordinary residential tenancy is), the written statement has been given before the tenancy is entered into, and each tenant signs from their own email account. Speed is not the risk; skipping a step is. The checklist in this guide is the order that keeps each step provable.
Can the tenant sign before they have seen the property?
Legally the agreement is formed when both sides sign, so yes. Practically, a tenant who signs sight unseen and then disputes the condition is a deposit argument in waiting. Send the inventory for signature on move-in day with an attachment field for their own photos.
What if a tenant has no smartphone?
The signing page works on any computer with a browser. If a tenant has no email address or device at all, sign on paper or host the signing in person on your own device, which the certificate records.
Do I still need the tenant's wet signature on the deposit prescribed information?
The Housing Act 2004 requires the prescribed information to be given to the tenant within 30 days of receiving the deposit and, under the regulations, the landlord to sign it; it does not require the tenant's signature, though a "received" acknowledgement is useful evidence. Include it in the pack as a read-and-acknowledge document and check the current regulations for anything the Renters' Rights Act changed.
Can I reuse last year's template?
Not unchanged. Tenancies granted in England from 1 May 2026 are periodic assured tenancies under the Renters' Rights Act 2025 and must come with the written statement of terms. Update the agreement and the template together; anchored fields re-place themselves on the new file.
